Overview of the Defence and Sensitive Security Procurement Directive

The Defence and Sensitive Security Procurement Directive (Directive 2009/81/EC) was established in 2009 and subsequently assessed by the European Commission in 2016, as well as by the European Parliament in 2020. Given the contemporary challenges and the dynamic nature of defence procurement, a revision of this legal framework is anticipated in line with the Defence Readiness Roadmap, slated for October 2025.

Context of the Revision

This forthcoming revision distinguishes itself from the concurrent revision of public procurement directives applicable to sectors other than defence. The aim is to specifically enhance the framework governing defence-related acquisitions.

Objectives of the Revision

While there have been targeted amendments proposed via the June 2025 Defence Readiness Omnibus, further assessment is needed to:

  • Promote Efficiency: Streamline procurement processes to ensure timely acquisitions.
  • Enhance Transparency: Foster clarity and openness in procurement procedures.
  • Boost Competitiveness: Strengthen the position of European entities within the global defence market.

The ultimate aim is to facilitate a genuine Single Market for defence products and services. This is vital for enabling Member States to procure defence and sensitive security equipment swiftly, economically, and cohesively while bolstering the resilience and technological independence of the European Defence Technological and Industrial Base (EDTIB).

Stakeholder Engagement and Contributions

To ensure a comprehensive and inclusive revision process, the Directorate-General for Defence Industry and Space (DG DEFIS) has initiated a call for evidence and a public consultation. Launched on November 24, 2025, this initiative invites stakeholders to contribute their insights, research, and position papers until February 16, 2026.

  • Report: A concluding report summarizing the results of the public consultation will be disseminated thereafter.
