Feds Should Receive Most Backpay by Nov. 19, Administration States

Federal Backpay Distribution Following Government Shutdown

In the wake of the recent protracted government shutdown, which lasted 43 days, federal employees are poised to receive their initial post-shutdown wages. This payment cycle, expected between Saturday and Wednesday of the upcoming week, will incorporate nearly all owed backpay as confirmed by senior officials from the Trump administration.

Legislative Framework for Backpay

Lawmakers incorporated a stipulation ensuring complete backpay for employees on furlough as part of the agreement that resolved the shutdown. This action was crucial following earlier remarks from the White House, which suggested potential noncompliance with a 2019 statute mandating that all federal workers receive compensation once appropriations are reinstated.

Timeline for Compensation

The upcoming disbursement of wages will be staggered across different federal agencies:

  • Saturday: Employees from the General Services Administration (GSA) and the Office of Personnel Management (OPM) will receive their salaries.
  • Sunday: Civilian personnel from the Departments of Energy, Health and Human Services, Veterans Affairs, and Defense will obtain their payments.
  • Monday: Compensation will be issued to workers in the Departments of Education, State, Interior, and Transportation, along with the Environmental Protection Agency, NASA, the National Science Foundation, Nuclear Regulatory Commission, and the Social Security Administration.
  • Wednesday, Nov. 19: A second round of payments will reach employees from the Departments of Agriculture, Commerce, Homeland Security, Housing and Urban Development, Justice, Labor, Treasury, and the Small Business Administration, covering both shutdown period pay and subsequent payroll for Nov. 2–Nov. 15.

Payroll Considerations

Recent guidance from OPM’s Associate Director for Workforce Policy and Innovation, Veronica Hinton, outlines how agencies should compute backpay, with an emphasis on the possibility of errors during swift payroll processing. She indicated that to expedite retroactive payments, adjustments may be necessary, and these initial payments might not fully align with established guidelines regarding pay, leave, and related benefits.

Specifics of Backpay Entitlement

  • Excepted Employees: Those who worked during the shutdown will be compensated for all hours logged, including any applicable overtime.
  • Furloughed Employees: These individuals will be eligible for payment corresponding to hours they were scheduled to work but did not due to the shutdown. This includes overtime pay for those who were regularly scheduled to exceed normal work hours.

The OPM clarified that:

“A furloughed employee who, prior to the lapse in appropriations, was regularly scheduled for overtime work or night shifts will receive the appropriate premium pay, akin to if the work had been completed.”

Exclusions from Backpay

Certain employees will not qualify for backpay, including those who were in a leave without pay status or those suspended during the lapse. Additionally, excepted personnel classified as Absent Without Leave (AWOL) due to unexcused absences will not receive compensation for missed hours.

Controversially, the Social Security Administration denied requests from some of its employees to be designated as intermittently furloughed, instead categorizing them as AWOL, which has raised concerns regarding compliance with shutdown protocols.

In summary, while the reinstatement of federal pay is a positive development, the complexities surrounding backpay and associated calculations necessitate careful navigation to ensure employees receive the rightful compensation for hours worked and lost.
